Governing Documents
These are the recorded dedicatory instruments that govern Village at Ledge Stone COA. They are posted here for members and residents in accordance with the Association's obligations under the Texas Uniform Condominium Act (Tex. Prop. Code ch. 82, and in particular §82.1142).
Which version controls. The recorded instrument filed in the Official Public Records of Hays County, Texas is the authoritative version. The reading copies below are unofficial convenience transcriptions; if a reading copy and the recorded instrument differ, the recorded instrument controls. Every entry links to the county record so you can verify against the source or pay to download your own official copy.
How these documents fit together
The condominium sits inside the larger master-planned community of Village at Ledge Stone, which is administered by the master property owners association (the VLSPOA). Two layers of covenants apply:
- The Master Covenant is community-wide and is administered by the master (property owners) association. In that instrument, "Property" does not include the condominium.
- The Condominium Declaration creates the condominium regime and binds every unit here. It is administered by this Association (the VLSCOA), together with the recorded Community Manual (which contains the Certificate of Formation, Bylaws, Rules & Regulations, the Assessment Collection Policy, and the Fine Policy) and the Design Guidelines (also shared by both associations).
- Only the Master Covenant and the Design Guidelines are shared across both communities. The Master Covenant largely reaches condominium owners only insofar as it governs their membership in the master property owners association (the VLSPOA); the condominium's day-to-day governance flows from the Condominium Declaration and Community Manual above.
Which law controls, and in what order
All of the Association's governing documents are controlled by the Texas Uniform Condominium Act (Texas Property Code chapter 82): where any provision of a recorded instrument conflicts with chapter 82, the statute supersedes it (§82.004).
The Association is also registered with the Texas Secretary of State, through its Certificate of Formation, as a Texas nonprofit corporation. This further requires all Association and Board activities to comply with the Texas Business Organizations Code, chapter 22: Nonprofit Corporations.
The recorded instruments below are listed in hierarchy order. A higher document takes precedence over anything below it — for example, the Master Covenant controls if a provision in a subordinate document conflicts with it. Higher-level documents typically speak broadly and generically, while each subordinate document provides greater specificity and clarity; the specific always controls over the generic.
Each instrument's own Definitions article controls what its capitalized terms mean. The same word can mean different things in the Master Covenant and in the Declaration.
